Terms and Conditions - Rentals

The following sets out terms and conditions that apply to your rental of any product from Supursestyle on the website located at supursestyle.com.

 

1-   SUPURSESTYLE RENTAL AGREEMENT

 

Supursestyle provides a handbag rental service, by which you place an order for a selected handbag through the website located at supursestyle.com (the "Site"), make a payment according to the term and prices published on the Site, and have the handbag shipped to the your address. All of this with no due dates or limits on the number of times a member can rent. However, Supursestyle reserves the right to ask for a deposit and/or limit the number of handbags that you may rent at any time and/or to require the return of any or all rented items in your possession in the event you fail to make required payments on time or in the event other factors arise which, in our sole discretion, increase the risk of non-timely payment by you. The current weekly and monthly rental rates for each handbag are published on the Site. Supursestyle reserves the right to change prices at its own discretion, however, if a handbag is already rented, Supursestyle will respect the original price at the time of first rental term for any additional terms.

  

2-   RENTAL TERM

 

You agree to return the handbag to Supuresstyle on or before the return date for the handbag that is identified in the online invoice for your order. You may extend your order for a handbag on the site, or by phone to Supursestyle; provided that any extensions are subject to other orders for that handbag and to pre-payment of the additional rental fee applicable to that handbag for the period of time of the extension. Shipping times are not included in your Rental Term. The Rental Term will begin on the day of delivery to the customer (verified by the shipment tracking) and conclude on the day that the customer ships the handbag back to our fashion house (verified by the shipment tracking). The Rental Term is calculated in calendar days. If the end of a rental term occurs on a weekend or holiday when the carrier is closed, the following available business day will be used for calculations. Please keep records of both deliveries in case of missing shipments and as proof of filing.

 

3-   SHIPPING

 

The current shipping policies governing the delivery and return of items are detailed on the Site. Delivery time for items you have selected to lease may vary based upon (a) inventory availability, (b) your delivery address, (c) when you place an order, and (d) other circumstances impacting delivery. Accordingly, Supursestyle makes no guarantees as to actual delivery time. We will send you an email letting you know when your item is shipped. The risk of loss for items shipped passes to you upon delivery by UPS. All UPS confirmed deliveries are the sole responsibility of the recipient. If you are unable to locate a confirmed delivery, you are required to contact Supursestyle immediately to place a tracer investigation with UPS and to temporarily suspend the rental period. All tracers take 8-12 business days to complete and until the results of the investigation are received, we are not able to proceed with the resolution of a lost item. Your billing address must be the same as the shipping address. Due to credit card procedures, we cannot ship to a different address than we bill to. Supursestyle may ship to a non-billing address once a history has been established with the Customer, however, if your order is shipping to an address other than the billing address on your credit card, we may contact you to list the alternate address with your credit card company. Your order will not be processed until your payment has been confirmed. This helps prevent fraudulent use of your credit card.

 

4-   PAYMENT

 

We accept credit card payments with American Express, Visa, and Mastercard only. No cash, checks, pre-paid cards or PayPal payments are not accepted as a form of payment at this time.

 

Your first month’s rental fee is due at the time of processing your order. If your credit card is denied for any reason, your rental will not be processed until you provide a new, valid card to Supursestyle, to charge the rental fees and credit card hold.

 

If your credit card has expired, is declined or no longer valid while in possession of one or Supursestyle’s handbags and a new rental terms is due, you must update your payment information as soon as possible to avoid any late payment or cancellation fees. The company reserves the right to request all outstanding items to be returned until outstanding payments by the customer are cleared, and reserves the right to use different means to collect payments from you including but not limited to legal action and/or private collection agencies.

 

5-  PRE-AUTHORIZATION AND BACKGROUND CHECK

 

Supursestyle reserves the right to ask for a deposit and/or limit the number of items that a customer may rent at any time and/or to require the return of any or all rented items in a member's possession in the event you fail to make required payments on time or in the event other factors arise which, in our sole discretion, increase the risk of non-timely payment by you. Deposits will be refunded once  the handbag has been returned and cleared of damage or can be put towards another rental upon the customers request. Supursestyle reserves the right to perform a personal background check with our approved third party vendor prior to fulfilling your order. All information Supursestyle obtains via the background check will remain confidential.

 

6-   DAMAGE; NON-RETURN; COUNTERFEIT RETURN

 

Handbags available for rental by Supursestyle are new or slightly used. It is expected that you take necessary cautions with the rented handbags to prevent damage and keep them in their original condition as much as possible: avoid placing liquids in them, exposing them to extreme weather conditions or to humidity, heat and or any other potential source of damage. Upon delivery, you bear responsibility for for loss, destruction or damage to the handbags due to theft, mysterious disappearance, fire, major stains or any other cause, other than normal wear and tear.

 

If you return an item with excessive or abusive damage exceeding normal wear and tear, as determined by Supursestyle in its sole discretion, you agree that Supursestylel may charge your payment card and collect a repair fee or a replacement fee. You will be invoiced separately for any repairs and will be provided with documentation of the repair for your records. If Supursestyle, at its sole discretion, determines that the item is not repairable, or that a repair is not cost-effective, you will be charged a replacement fee. Replacement fees may be based on the MSRP (manufacturer’s suggested retail price) or the market value of a used item if it already presented wear and tear as stated in the product details tab ‘Condition’ on our website for the specific handbag. If you do damage your rental, you must notify Supursestyle immediately. When damage occurs to a handbag beyond normal wear and tear, you are required to immediately communicate to Supursestyle via phone (1-800-840-1696) or email to customercare@supursestyle.com. The handbag will need to be sent back to our fashion house immediately for evaluation. Under no circumstances should you attempt to have the item repaired—any efforts on your behalf to do so will result in you being charged the full MSRP replacement fee for the rented item. If the repairs of the damaged handbag takes beyond the expiration of your Rental Term, Supursestyle will charge you for another Rental Term until the handbag is completely repaired and can be rented again.

 

You are also responsible in the event of a theft or loss of a handbag and therefore you will be responsible for the full MSRP retail price immediately upon notification of the loss of the item. Rental fees will continue to accrue until the payment is received in full. Also Supursestyle reserves the right to close your account at any time if we notice multiple cases of excessive damage or abuse to the items you have rented. You should notifiy Supursestyle immediately via phone (1-800-840-1696) or email at customercare@supursestyle.com when the item is lost or stolen.

 

Supursestyle validates that the original handbags are returned once they arrive at our fashion house. If an item is detected to be a copy or counterfeit, Supursestyle will charge you the full MSRP retail price, close your account immediately, and may notify appropriate law enforcement officials of the theft.

 

If you return the item(s) late, a late fee of twenty-five dollars ($25.00) will be charged to the payment card you used to pay the rental fee or to any other payment card included in your account information that you have provided to Supursestyle for every day that you are late returning the item(s), and you agree to pay such late fees, up to an amount not to exceed 100% of the MSRP retail value plus applicable sales tax (plus the rental fee). The late fee is payable for each for each item that is the subject of the order that is late. If you have not returned a Product within twenty (20) days after the return date for the item, your late return will be considered a non-return and Supursestyle will charge your payment card the maximum late fee set forth in this Section 6, less any late fees that you have already paid, plus applicable sales tax.

 

7-   RETURNS AND REFUNDS

 

Supursestyle accepts returns for Product rentals, provided that:

 

1. The Product is deposited with UPS for return shipping within 48 hrs of receipt in shipping address

2. The Supursestyle tag must still be attached; AND

3. The Product must be unworn and in original condition.

 

Members will be reimbursed for the full amount of the rental originally paid minus expedited shipping fees. Since the pre-paid return label is provided at the time of lease of the item, the return shipping fee will be discounted from any refunded amount.

 

8-   PERSONAL USE ONLY

 

Handbags rented from Supursestyle are for personal use only. Handbags may not be sublet, loaned or used for professional or commercial purposes.

 

9-   TERMINATION

 

Supursestyle reserves the right to close a member account for any reason. Upon account termination, you must immediately return any items you currently have rented and will receive a refund for the current rental period, provided the item is returned in good condition in a timely manner.

 

10-   MISCELLANEOUS

 

For purposes of this agreement, the term 'Rent' and 'Lease' are used indistinctly.

 

This Rental Agreement constitutes the entire agreement between you and Supursestyle regarding this rental and supersedes any prior agreements between you and Supursestyle for merchandise rentals.

 

No waiver by Supursestyle of any breach or default hereunder is a waiver of any preceding or subsequent breach or default.

 

The section headings of the Agreement used herein are for convenience only and shall be of no legal force or effect.

 

If any provision of the Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions and the remaining portions of the Agreement shall continue in full force and effect. The failure of either party to exercise any of its rights under the Agreement shall not be deemed a waiver or forfeiture of such rights or any other rights provided hereunder.

 

This Agreement and any legal issues arising out of this Agreement are governed by and in accordance with the laws of the State of Texas without regard to its conflict of law provisions.

 

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to this Agreement must be filed within one (1) years after such claim or cause of action arose or be forever barred.

 

You agree that any dispute or claim arising out of or in connection with this Agreement shall be subject to the jurisdiction of the courts of the State of Texas or the Federal District Courts for Texas.
